Terms & Conditions
Standard terms and conditions apply on all orders and services including but not limited to Web Design, Hosting, Duplication, Print and Video Transfer. pushStar Multimedia, LLC can not be held financially responsible for any and all, but not limited to errors, viruses or missed promised delivery dates.
Below is a listing of our standard terms and conditions.
By placing an order with us pushStar Multimedia, pushStar.com, pushStar or any other name(s) you may know us by, you (the client) agree to be bound by the following terms and conditions. The client also agrees to hold pushStar harmless for any misrepresentation or failure to perform or deliver any project submitted by client.
PRICING
All pricing is subject to change at any time and without notice. Price quotes and turn times are not guaranteed on any and all products and services including, but not limited to, print on demand, web design, hosting, templates and video conversion.
We accept all major credit cards through a number of different payment processors including Authorize.net, PayPal, Google Checkout and 2Checkout. Payment is non-refundable after written proof approval.
Prices do not include shipping or applicable tax. We ship UPS GROUND from a number of different printers and distributors including but not limited to New Jersey, California, Texas and Virginia unless otherwise specified.
pushStar requires prepayment in full on all duplication/replication orders. pushStar requires a 40% deposit on Web Design services and the balance is due at proof approval. All orders are deemed non-refundable after written proof approval. On the rare occassion that an order is deemed refundable the refund will be made in the form of a credit for product and/or service from pushStar, less any and all, but not limited to, previous fees for labor, product or development.
pushStar Multimedia, LLC reserves the right to refuse or cancel any order for any reason.
PROOFS, PRINT AND COLOR
All printers and monitors are calibrated differently and in no way do we guarantee color matching on your final printed product and orders will not be refunded for such a reason. Orders will not go into production without a signed off proof. All orders are non-refundable after written proof is received.
pushStar is NOT RESPONSIBLE for items that would prevent the file from being CORRECTLY printed such as missing files, resolution, color mode, missing fonts and images, proper bleed, etc. It is also your responsibility to check backup and pagination of files, size and trim, folds, perfing and scoring.
PAYMENT
Web Design orders require a 40% deposit to begin work and the balance at time of proof approval to continue production.
Print on Demand, Web Hositng, Domain registration and transfer, flash templates and video transfer require prepayment in full and are non-refundable.
Web hosting & Domain registration fees can and will be deducted from, but not limited to, any initial deposits paid.
Once an order has been received by pushStar and approved by the client, refunds are not allowed.
INDEMNIFICATION
The client agrees to protect pushStar from economic loss and any other harmful consequences that could arise in connection with the work. This means that the client will hold pushStar harmless and save, indemnify, and otherwise defend pushStar against claims, demands, actions, and proceedings on any and all grounds. This will apply regardless of responsibility for negligence.
SHIPPING
The client is responsible for the job once it leaves our location or one of our printers/distributors locations. We do not guarantee shipping times. The client is responsible for the relationship with the common carrier. The title and ownership of the job transfers to the client once it leaves our location. The client is also responsible to make any claims on shipping damage with the common carrier.
DISPUTES
In the case of a dispute or legal action both parties (the client and pushStar) agree that any action will be filed and litigated in Burlington County, NJ. The client also agrees to arbitration rather than legal action through the courts. The client agrees to have pushStar provide an arbitrator acceptable to both parties.
IPR
Any and all customers agree that they own the rights to the intellectual property for any content they are submitting for duplication or creative services and can not hold pushStar multimedia responsible in any legal action when dealing with IPR issues and concerns.
